ReleaseWire is a set of related websites, providing press release distribution and related services, including connect.releasewire.com, publisher.releasewire.com, sbwire.com, hostednr.com among others ("SITE"), owned and operated by ReleaseWire LLC (“RELEASEWIRE”, “we” or “us”), a Wisconsin Limited Liability Company. We provide you with this Terms of Service agreement to advise you of the legal obligations you assume when you choose to access or use the SITE.
By using the ReleaseWire network of sites (releasewire.com, sbwire.com, and/or hostednr.com web sites ("SITE") operated by ReleaseWire LLC ("RELEASEWIRE"), users agree to be bound by the following terms of Services.
1 TERMS OF SERVICE

2 ADDITIONAL AGREEMNTS
All submissions to RELEASEWIRE are governed by the terms and conditions set forth in the Content Distribution Terms of Service agreement ("DISTRIBUTION AGREEMENT"). By submitting a content to be distributed by RELEASEWIRE, you agree to be bound by the terms and conditions set forth in the DISTRIBUTION AGREEMENT. In the event of any conflict between the DISTRIBUTION AGREEMENT and this Terms of Service agreement, the Terms of Service agreement shall prevail.
3 AGE ELIGIBILITY
You must be at least 13 years of age to access or use the SITE. By accessing or using the SITE in any manor, you represent and warrant that you are at least 13 years old. If you are under 13 years of age you may not access or use the SITE in any manner for any reason. If you are under 13 years of age may create an account or provide any personal information to RELEASEWIRE or any other SITE members by using the SITE. This includes your name, email address, physical address, telephone number.
4 LIMITATIONS OF SCOPE OF USE
Use of the SITE is limited to viewing of content, submission of content for distribution and registration for and use of offered products and services.
5 YOUR OBLIGATIONS
You agree not to use SITE for any other purposes, including, without limitation, to store, aggregate, reproduce or distribute information available on the SITE in any manner or to compete directly or indirectly with RELEASEWIRE; to interfere with or disrupt the operation of SITE or the networks or servers connected to the SITE in any manner; to impersonate any person or entity or otherwise misrepresent your affiliation with any person or entity; to upload, post or otherwise transmit any content that infringes the proprietary rights of any third party, or is otherwise unlawful or offensive; to harass or otherwise harm RELEASEWIRE or any other person or entity; or to engage in commercial activities of any kind without prior consent of RELEASEWIRE.
You may not use the SITE or any offered Products and Services if the accessing or use of the SITE conflict with any applicable laws of your jurisdiction.
RELEASEWIRE reserves the right to refuse, suspend or terminate your access to the SITE if RELEASEWIRE determines, in its sole discretion, that you have in anyway violated this Terms of Service agreement or any related agreements or policies set forth by RELEASEWIRE.
Any unauthorized use of the SITE may result in termination of all rights to use the SITE and penalties to the full extent provided by law.
6 NO WARRANTIES BY RELEASEWIRE
EXCEPT AS STATED IN THIS AGREEMENT, RELEASEWIRE MAKES NO WARRANTY REGARDING SERVICES PROVIDED BY RELEASEWIRE OR RELEASEWIRE'S AFFILIATES. RELEASEWIRE HEREBY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION, ANY WARRANTIES AS TO THE AVAILABILITY AND ACCURACY OF CONTENT AND ANY WARRANTIES AGAINST NON-INFRINGEMENT.
7 LIMITATION OF LIABILITIES
Any liability of RELEASEWIRE, RELEASEWIRE's affiliates or employees, for the failure of any performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortious behavior, negligence, or under any other cause or action, shall be strictly limited to a return of any amount paid by or on behalf of the User to RELEASEWIRE. IN NO EVENT SHALL RELEASEWIRE, RELEASEWIRE's AFFILIATES OR EMPLOYEES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, ANY LOSS OF REVENUE, LOST PROFITS, OR LOSS OF DATA).
8 DISCLAIMER OF LIABILITY FOR THIRD PARTY CONTENT AND LINKS
You agree that RELEASEWIRE is not responsible and will not be held liable for any third party content on the SITE or any third-party content, products or services available on other Web sites accessed through links from the SITE. Links to third-party sites are for your convenience only, and their inclusion on the SITE does not imply any endorsement, guarantee, warranty or representation by RELEASEWIRE.
9 PROPRIETARY RIGHTS
The SITE and all materials on the SITE, including, without limitation, "ReleaseWire" and all other trademarks and logos on the SITE, are protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as specifically permitted in this Agreement, the DISTRIBUTION AGREEMENT or by express written consent of RELEASEWIRE, you may not use the SITE or the material on the SITE in any manner.
10 ASSIGNMENT
RELEASEWIRE reserves the right to assign our rights and obligations under this Terms and Conditions agreement (in whole or in part) without your consent to a corporate affiliate, or in connection with a merger, acquisition, corporate restructure or reorganization, or due to the sale of all or substantially all of our assets.
11 GOVERNING LAW AND JURISDICTION
This Terms of Service agreement will be governed by and construed in accordance with the applicable laws of the State of Wisconsin without reference to its conflict of laws provisions. Any dispute or claim arising out of or relating to the Agreement or claim of breach hereof shall be brought exclusively in the Courts of the State of Wisconsin. You and RELEASEWIRE hereby consent to the exclusive jurisdiction of such courts, and waive any right to challenge jurisdiction or venue in such courts with regard to any suit, action, or proceeding under or in connection with the Terms of Service agreement.
12 NOTICES
All notices must be provided in writing, by email or by posting on the SITE.
13 RIGHTS RESERVED AND CHANGE IN TERMS
Any rights not expressly granted herein are reserved. RELEASEWIRE reserves the right to make changes to these terms and conditions at any time and for any reason by posting a notice on the Site home page. All such changes will become effective 10 days after posting of such notice. Your continued use of the Site after the date such changes become effective will constitute your acceptance of the changes and your agreement to be legally bound by any modifications or amendments to these terms and conditions.
